Terms and Conditions

  1. General
    • 1.1 The Website is operated by Untamed Education Limited (Company Number 08337622) under the URL www.a-pe.co.uk and www.a-pe.org.uk.
    • 1.2 By accessing the Website, You agree to be bound by these terms and conditions to the extent that they apply to freely accessible material.
    • 1.3 By submitting an Application, You agree to be bound by these terms and conditions to the extent that they apply to the Content and the Subscription Service.
    • 1.4 We reserve the right to vary or amend these terms and conditions at any time and any amendments will become effective immediately upon posting them on the Website.
    • 1.5 You are responsible for ensuring you are familiar with the latest terms and conditions and that any User is also familiar with and agrees to be bound by these terms and conditions.
  2. The Website
    • 2.1 We make no warranty or representation that:
      • 2.1.1 The Website will be uninterrupted, timely, secure or error free;
      • 2.1.2 The contents of the Website are free from infection by contaminating or destructive properties;
      • 2.1.3 The data You transmit via the Website is totally secure.
    • 2.2 Any material downloaded or otherwise obtained by You through the use of the Website, including the Subscription Service, is done at your own discretion and risk and on the basis that You will be solely responsible for any damage to your computer hardware or network or loss of data that results from the download of any such material.
    • 2.3 We reserve the right to alter without notice the arrangements for access to the Website and the Subscription Service or to change the content, presentation and / or facilities of the Subscription Service.
  3. The Subscription Service
    • 3.1 In order to access to the Subscription Service, You must make an Application and pay the relevant Fee.
    • 3.2 On receipt of the Fee, We will provide You with a username(s) and password(s) that will permit the Users nominated in the Application to access the Subscription Service via the Website.
    • 3.3 Your right to access the Subscription Service is non-exclusive and non-transferable and You must not permit anyone other than a nominated User to use the username(s) or password.
    • 3.4 You acknowledge and agree that we may monitor access to the Subscription Service by You and your nominated Users through access data.
    • 3.5 If We hold the reasonable belief that a username(s) or password(s) is being used in a way which is not permitted under these terms and conditions, We reserve the right to terminate or suspend your access to the Subscription Service and / or issue a new username and password.
    • 3.6 You acknowledge that termination or suspension of your access to the Subscription Service by Us for any reason will not entitle You to a refund of the Fee paid to Us prior to the date of such termination or suspension.
  4. The Content
    • 4.1 Whilst due care has been taken in preparation of the Content, We do not warrant its completeness in respect of the syllabus for the relevant examination board.
    • 4.2 We reserve the right to alter or amend the Content at anytime during the period of the Subscription Service without notification.
    • 4.3 Subject to the intellectual property provisions in clause 5, You and your nominated Users may upload the Content to a secure internal network for use by students.
  5. 5 Intellectual Property
    • 5.1 Copyright in the Content is vested in Us. You do not acquire or hold any ownership rights or intellectual property rights by downloading, copying, amending or personalising the Content, or any part thereof, from the Website.
    • 5.2 You are permitted to print, download and amend the Content from the Website solely for your own non-commercial, individual teaching and learning purposes. Any Content so downloaded may be stored on your computer or, if you are a school or company, on your network, for use during the period of the Subscription Service only.
    • 5.3 On expiry of the Subscription Service, You and all Users must delete all Content stored on any computer hardware or network.
    • 5.4 You may not redistribute, broadcast or upload Content from the Website, except to a secure internal network owned and managed by You or a User, without prior written permission from Us.
    • 5.5 You agree to take all actions and do all things reasonably necessary or desirable to protect our intellectual property rights in the Content.
  6. Cancellation of the Subscription Service
    • 6.1 If You cancel the Subscription Service within seven (7) days of being provided with access, We will provide You with a refund of the Fee following confirmation from You that all Users have deleted all Content stored on any computer hardware or network.
    • 6.2 If You cancel the Subscription Service after the period outlined in clause 6.1, You will not be entitled to a refund of the Fee.
  7. Personal Information
    • 7.1 We will use your personal information only for the purposes of providing the Subscription Service to You.
    • 7.2 Our use of personal data is set out in our privacy policy and our use of cookies is set out in our cookie policy. By using the Website, You are agreeing to the provisions set out in our privacy policy and cookie policy.
  8. Indemnification
    • 8.1 You must indemnify Us and our directors, employees and agents from and against any claims, causes of action, demands, losses, damages or other costs or expenses brought by third parties as a result of:
      • 8.1.1 Your use of the Website, Subscription Service or Content;
      • 8.1.2 Your breach of these terms and conditions;
      • 8.1.3 Your violation of any law or the rights of a third party.
  9. Miscellaneous
    • 9.1 These terms and conditions are governed by English law and You consent to the exclusive jurisdiction of the courts of England in all disputes relating to the use of the Website Subscription Service or Content.
    • 9.2 Use of the Website Subscription Service and Content is unauthorised in any jurisdiction that does not give effect to all provisions of these terms and conditions.
    • 9.3 If any part of these terms and conditions are determined to be invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the terms and conditions will continue in effect.
  10. Definitions
    • Application means the application for a particular Subscription Service.
    • Content means the curriculum material in respect of the relevant examination board syllabus made available as part of the Subscription Service.
    • Fee means the annual subscription fee payable by You to Us to access the Subscription Service.
    • Subscriber / You means the school, company or individual who makes the Application for the Subscription Service.
    • Subscription Service means one of the packages offered by Us to access to the Content for a period of 12 months via the Website from the date of invoice for the Fee.
    • User means any student or teacher in respect of whom You have nominated to access the Content as part of your Subscription Service package made an Application and paid the Fee.
    • We / Us means Untamed Education Limited (Company Number 08337622)
    • Website means the website operated by Uus at the URL www.a-pe.co.uk and www.a-pe.org.uk.
